Reporting grievances, violations, illegal activities

The companies and employees of the NUSSLI Group are committed to themselves and to third parties to conduct their business activities in strict compliance with at least all relevant legal standards. In order to adequately fulfill this self-imposed and third-party obligation as well as the relevant national standards for the protection of so-called whistleblowers, we have set up a protected system for reporting information on possible criminal offenses, administrative offenses, violations of legal regulations (e.g. regarding money laundering, corruption, tax law, public procurement, product safety, environmental protection, data protection, discrimination, harassment).

This system is open to all natural persons who have obtained information about violations in connection with their professional activity or in the run-up to a professional activity and wish to report or disclose them. These are, for example, employees and coworkers, trainees, applicants, temporary workers, subcontractors (professional context), external employees/freelancers.

Please note: for your own protection, you should only report a possible violation if there are reasonable grounds for suspicion. A mere suspicion is not sufficient. In the case of false suspicions, rumors, speculation and reports of private misconduct unrelated to professional activities, you do not enjoy the statutory protection against reprisals (sanctions, discrimination, disadvantages) that otherwise exists for whistleblowers. Furthermore, in such cases there is a risk under criminal and civil law.

A standardized internal reporting office set up for the companies of the NUSSLI Group is available to you for reporting substantiated cases of suspicion. You can submit your reports to this reporting office via various reporting channels. You also have the option of submitting anonymous reports. However, you can only receive feedback on the processing status and follow-up measures of your report by providing a contact option. Please let us know whether and how you would like to be contacted. At your request, there is also the possibility of a personal meeting (also via audio/video systems). The reporting channels are:

Reports are treated in strict confidence by MROS, taking into account all data protection requirements, and are only accessible to the responsible employees of MROS. This applies in particular to the identity of all persons who are the subject of a report. The employees of the Reporting Office carry out their tasks independently and free of conflicts of interest and have the necessary specialist knowledge. Upon receipt of a report, the internal reporting office:

  • confirm receipt of your notification after seven days at the latest [1] ,
  • check whether the reported violation falls within the material scope of the applicable national legal standards for the protection of whistleblowers,
  • keep in touch with you [1],
  • ask you for further information if necessary [1],
  • take appropriate follow-up measures in accordance with the requirements of the applicable national legal standards,
  • provide you with feedback within three months after confirmation of the notification or three months and seven days after receipt of the notification [1] [2]

[1] If you have provided us with a contact option

[2] Notification of planned and taken follow-up measures, provided that internal inquiries or investigations are not affected and the rights of the persons who are the subject of a report or otherwise affected are not impaired.

Alternatively, you have the option of contacting external national reporting offices. These external national reporting offices are set up individually in accordance with the applicable national law. You can obtain further information on external reporting offices/procedures from the authorities in your country.

Reporting offices are authorized to process personal data insofar as this data is required to fulfill their tasks as defined by the applicable laws (reporting and clarification of the reported facts). Within the European Union, personal data is processed on the basis of Art. 6 para. 1 lit. c) GDPR in conjunction with the respective supplementary authorizing national legal norms. Within the Swiss Confederation, personal data is processed in accordance with Swiss data protection law insofar as this is necessary for the reporting and clarification of the reported facts.

The deletion of a report takes place after the expiry of the retention periods prescribed in the respective applicable national legal standards. Further information on your rights, such as the right of access, rectification, erasure, restriction of processing, data portability and other rights of objection and complaint, can be found in our privacy policy.
